Summary:碩士 === 國防管理學院 === 法律研究所 === 91 === Aside from the lowest-price award, the most advantageous award is one that comes from a process which evaluates all factors of the procurement, including quality, functions, efficiency, and costs, to the benefit of the government. The process should be in accordance with governmental policy, and ensure fairness and efficacy. Thus, the law of government procurement should follow the rules of the Constitution, and construct a fair system that gives all competitors full and effective rights to protect themselves. Governmental procurement should follow “due process of law” and be comparable to the laws and the regulations of the U.S, including the “Competition in Contracting Act ”, the “Procurement Integrity Act” and the “Federal Acquisition Regulation”, so that we can understand and review our acts and regulations. These resources provide advice for amending and rewriting the related codes.
