Study in Organizational Designation of the Department of Government Ethics in the Republic of China : A Perspective of New Institutionalism

碩士 === 國立成功大學 === 政治經濟學研究所專班 === 91 === In 1992, government authorities pushed forth administrative reform and attempted to institutionalize of Personnel Auditor Organization due to the corruption of government institution, and then they established the "Ethics Organization" on 18 August 1992. According to the designation of the Ethics organization, could it achieve the goal that made ethics correct and government clean and efficient? Mr. Liou Jan-Hua, the former Director-general of Government Ethics Department said, "The power to Ethics Officials is not complete." and Mr. Guan Gau-Yue ,the Deputy Director-general of Government Ethics Department said, "Government Ethics Officials have not three powers, no dignity, no resources and no investigative power." What would be any relations between the Ethics Organization’s Function and its structure? Kast said, "The Ethics structure can’t be a representative of the whole Ethics organization but is the most important part of the government institution. And Only the Ethics structure can show functions of the government institution." Therefore, the thesis will discuss the influence and limitation of the Ethics organization from the viewpoint of structure of the Ethics organization. The Ethics organization consist of 2,600 or more Government Ethics Officials and about eighty percent of them have the college diploma. The superior condition of human resource is rare among the government institution but central decision maker did not pay sufficient attention on them. In the thesis, I use the "new institutionalism" as an analytic framework to study to analyze the designation of Ethics Organization and the operation of it. According to the designation of anti-corruption organization in Hong Kong and Singapore, I will offer the suggestions of institutional reforms of the Ethics organization, Corruption Eliminating laws and anti-corruption laws, and the professional institution for corruption .
