These lands were donated by the locals who were enthusiastic about education .As a result of the particular nature,which was different from regular public lands,the land for education was defined as “The Foundation”reserving for the interest in scholarship. However,the authorities had not set up single, manageable regulations but selectively drew up rental regulations and parts of punitive rules according to the non-public land regulation of Taiwan Province-owned Property Management Rule.It resulted in:
1.a less of rental income
2.the occupation problem
3.the burden of land -use efficiency and managed manpower because of short lesse
4.the increased rate of damage of building before the end of lease caused from the lack of compensation when lease expires and a lure for renters to preserve buildings.
For these reasons, it is necessary for the authorities to review the rental management land for education.This study is to develop an advanced method of rental system and bases on the fairness and efficiency theory to explore how to improve and refer to domestic and international bibliographies for the use of public land,as well as consults opinions of the authorities and experts to build up enhanced strategies for rental management system of land for education. This research will be a reference for the authorities to make policy in the rental management of land for education. The conclusions are as follows:
1.Loosening occupyancy and incorporating the majority of occupation for management can take into consideration.The measure that offends against the fair principle will use the method of compensation- to double the compensation and rent-to make up.Moreover,the authorities strictly execute the policy that enforces illegal renters to return lands in order to eliminate the occupancy.
2.The rent rate should be evaluated referring to the market price, and it is not appropriate for a large difference with private lands,i.e.the rent setting or adjustment have better to reflect the market rent.
3.Loosening the lease can make renders invest efforts in the land in the long run and use it effectively. Also,the lease will be terrninated when the land has to return to the authorities.
4.In order to decrease the depreciation rate,renters might be compensated according to its reasons and lease.
