碩士 === 國立中正大學 === 勞工研究所 === 91 === Abstract Recently the growth of national income, the demand for more leisure activities has become more and more popular, especially professional sports. However, the field of professional sports replete with contract, antitrust and labor law elements that all appear to be mutually contradictory. This thesis attempts to understand the law principles relevant to professional sports. This thesis focuses on contractual dispute in professional sports. It attempts to analyze labor law and fair trade law applied. A Comparison of reserve clause, free agent compensation, drug test, the trade system, player conduct, termination, grievance and arbitration procedure between Taiwan and the U.S. professional sports. There is an analysis concerning player contract disputes between Taiwan and the US.
