Summary: | 碩士 === 國立成功大學 === 都市計劃學系碩博士班 === 90 === Starting with building code from Japanese colonial period, influenced by the U.S. zoning system and recently borrowed the British concept of development permit, the land use and development regulations in Taiwan have significant hybrid character. Although the official documents are based on the concept of the U.S. zoning ordinance, they are severely handicapped due to the lack of a comprehensive regulation structure and various implementation tools. The incomplete regulation structure and mechanism has resulted in the environmental chaos in cities of Taiwan. Lacking of a comprehensive plan as indication for future development, the zoning map become identical with master plan, and cities are regulated and developed on “case by case” bases without an overall intention. Without legitimate subdivision control, the juxtaposition of various building types and styles has created incoherent development in city area of Taiwan. The Capital Improvement Programs, which work as indicators for directing and managing urban growth are mostly concealed by random political preferences. For the zoning ordinance itself, the focus solely on “due process” has made location indifferent with land uses. Equal protection issues are mostly neglected that make the comprehensive view of the city impractical. The rigid zoning regulations applied with a building code principle indifferent of cities and locations has forced the cities in the island of Taiwan as one mode. This study is to reveal the hybrid and handicapped land use and development regulation in Taiwan to avoid creating further chaotic environment. By analyzing and comparing land use and development regulations of various cities in various countries, it is hoped that the roles and functions of urban planning regulations, urban design controls and building codes can be put in appropriate position and allow further integration. Furthermore, this study will recommend a comprehensive regulation system and complete implementation mechanism for land use and development control based on the special need and character of cities in Taiwan.
