Hence, river area has been added to the Article 13 under the Implementing Rules, governing Regional Planning, promulgated on July 7, 1997. Therefore, the delimitation of river areas is the predominant policy of the government based upon the laws concerned. However, since Aug 1, 2000, the delimitation of river areas has caused repercussions because people deem that there is discrepancy between the delimitation and the status of water flow. Thus, their lands, once classified into river areas, could be deflated in value and might lead to impact upon their rights and interests. To calm down the dispute of delimiting river areas, some local governments finally shelved the programs of classification of river areas before the public notification. However, on social benefit, the conflict of interest resulting from classification of river areas can be divided into four problems: the disputes in demarcation line of river areas, the shortcoming in the control of land use, the decline in land prices and the failure in land requisition. The study attempts to resolve the foregoing problems from the delimitation of river areas. This study was based upon the historical documents, theories concerned, government laws/regulations and statistical data. Also, the study sought the opinions from experts and landowners. Besides, the study made field surveys. The effective measures include four aspects: 1)Renewal of the survey and the delimitation in river areas: With water conservancy technology, the demarcation line of river areas should be surveyed again on the present water flow zone to guarantee people''s rights and interests indeed; 2)Establishment of the control model for zoning land use: The model for zoning regions should be built. Land in river areas should be catalogued for the available management of land use. Thus, land administration could perform by regions and zoning categorization. Hence, the violations of land regulations or abuses of single lots could be alleviated as far as possible. Meanwhile, the system could avoid disputes between the authorities concerned and land owners; 3)Appraisal of land prices: The appraisal of land prices in river areas should be revised. This appraisal may serve not only to hold the reasonable land prices but also to offer an important basis for compensation of land requisitioning and pricing of land bartering; 4)Barter for various catalogues of land: The fair batter system for land exchange between inside and outside of river areas should be established. This system could promote land separation and exchange in fair. Hence, the system could decrease the government’s finical expense for land requisitioning and also might alleviate disputes between the government concerned and the people of land in river areas.
