If we can’t solve the problems and make sure the direction of the land resources useform early, the problems will result in environmental impacts and inefficiency of land use. In order to offer ideas to solve the problem of unlawful cultivation, I collect the information about why unlawful cultivation happened in national forest and how to prevent it. Finally I use the case study of Chi─ke hill in Hualien Forestry District Administrative Office, analyzing the profit of unlawful cultivation and material environment, to make conclusions and provide some suggestions as follows : Suppression is the only legal way to handle unlawful cultivation. Government can punish unlawful cultivation by setting a time limit of planting trees, fine, imprisonment, terminating the contract of leased national forestland or uprooting crop directly. It can prevent new unlawful cultivation , but is still hard to solve the former problem of unlawful cultivation. In another way, the government increases gain to induce the farmers planting trees but the profit of unlawful cultivation is more than gain of planting trees. So the two ways still can’t solve the problems of unlawful cultivation. There are about 295.8 hectare farms in the research area. Hemerocallis fulva is major crop and it’s about 239.8 hectare. The total value of Hemerocallis fulva is NT﹩104,564,790 and the net profit is NT﹩47,014,708. So planting Hemerocallis fulva still has economic profit that it’s hard to suppress unlawful cultivation. There are three kinds of landslides in the research area, including rock fall, slump and soil erosion. The roads that contact with out─side go through rock fall zone. Some crops distribute in slump and soil erosion zone . Although the roads of Chi─ke hill are unstable that limit the development of the area, the area still has potentiality of agriculture. So if the traffic can be improved by technology, we could develop the area by relieving the national forest of Chi─ke hill that supply more land to people. It’s unfair to let the lands of unlawful cultivation become legal ,therefore we should develop a new system that can compensate the loss of society by paying a reasonable fee or rent from lessee.
