One is called the offical functional land which is used for the transportantion and the commercia use, and the other is called the non-offical land. The study of this paper is concerned about how to make use of the land for the Taiwan Railway Administration. There are two study items in the paper─one is how to make the offical function land more efficient, and the other is how to development the non-offical land. In addition that, I gave my suggestion form thre different courses in the end of this paper─ one is revising the existing law, another is the adjustment of hte existing constitution for the company, and the other is the way of redevelopment the non-offical land. The method of the study can be thought as following: 1. For the offical function land: Concerned about the interaction between the urban development and the railway, the scope for the land use can be discussed form these points, such as the urban development, the character of the railway station, the image of the activities node, the efficiency of the land use, as well as the budget for hte construction of new station and so on. Therefore, there are several issues for land use: (1) In the Railway Law, Taiwan Railway Administration can not have the accessory business to flourish the railway transortation. (2) Without the connected rules of transportation, there is short of the related regulation for the execution of land use. (3) Most of the land for the railway station in the prosperous area are belong to the railway land, that restricts the mix-use of land of the railway station. (4) They can not apply the rule that the public facility land can be mix-used. 2. For the non-offical land: The study of the non-offical land is concerned about the attitude and the way of Taiwan Railway Administration in dealing with the land. And with the experience of other countries and other methods about to deal with the land in our country, I am goint to study the good and the bad for Taiwan Railway Administration. During the study, I was also trying to find a propoer measure for the land issue for the land use by the paper investigation form the administration, the experts, the officers and the investors. The conclusion for the study is as following: 1. For the non-offical land: (1) Taiwan Railway Administration should do the estimation and the planing for each site, and find the one that has potential to do the investment. (2) The result of the paper investigation suggest to use the Build Operation Transfer to deal with the land development. (3) The sale of the ladn should keep the principle in justify, and take part of money for the foundation when the useless land have been sale. (4) As the example of other countries, the charge for the leasehold can be count in the prevailing price. 2. For the offical function land: (1) Taiwan Railway Administratioin should consider to apply some of the national railway regulations, and belong to National railway Administration in the feature. (2) They should ease the rules for the local railway administration to do the accessory business for flourishing the railway transportation. (3) The land of Taiwan Railway Administratioin can not apply the rules of mix-use. And compared to TMT and Bureau of Taiwan High-spped Rail, it is better to amend the rules of mix-use on public facility land, or to change the land use for the land of Taiwan Railway Administration. (4) Compared to TMT and Bureau of Taiwan High-Speed Rail, the profit and losses of Taiwan Railway Administration can not be used flexibly. (5) Taiwan Railway Administration should have completely coordinate with the local government when the land want to apply the rules of mix-use on public facility land. 3. For the adjustment of the existing constitution: (1) For the long-term management, Taiwan Railway Administration should have a department to cooperate with the others or take it as a project to deal with the land. (2) Based on the need of business and the adjustment of the existing constitution, Taiwan Railway Administration should expend the real estates team to become a independent department for the short term, and to a development department of real estates for the long term. (3) Taiwan Railway Administration should separate the manage and the administration to release the working obligation, focus on the independence of business, and give the right of management to the private institution.
