碩士 === 淡江大學 === 日本研究所 === 85 === In the society with huge production and consumption as well as the protection of the manufacturers are getting increasely to follow.In the view of a suitableaid to the victim ,the responsibility about damage compensation is transformed from "fault" to "defect" in the area of cases of Product Liability ,which claarifys the argument of a lawsuit,fasten the justice ,and ease the burden of proof of the victim -these are all the aims of the system of Product Liability.The practice of Product Liability Law making the prerequisite transform from"fault" to "defect" leads to justice experience''s being introduced in substantive law and it means a lot in decreasing the chaos about producers''legal obligation and increasing the stability in laws .With the introduction of the new system,though outside the judging occasions ,Product Liability Law,facilitates in rules of solving arguments .Besides,it''s also important in stability of solving and solving speed of arguments.Moreover,it''s expected in heightening the consciousness of both producers and customers, improving the manufacture''s handwork,making sure of the safety in production,and producing those which is made according to customers'' needs.Last, Product Liability Law also plays an important role to improve peoples'' living safety and the sound development of economy of the country.
