Summary: | 碩士 === 淡江大學 === 歐洲研究所 === 81 === One of the main aims of the European Community is establishing
a common market. And according to the theory of economic
integration, this depends on the promotion of the free movement
of all factors of production, involving not only goods, but
also labor and capital. In the EEC Treaty, there are provisions
regarding the free move- ment of persons, especially the
provisions of the articles 48-51. They regulate the situtions
of the free movement of employed persons (or workers): the
right to leave from home country and enter a Member State, the
right to reside、work and remain in the territory of that
Member State and the right to be treated equally, and so on.
From which provisions are these rights derived? To whom are
these rights applicable? And by taking what measures can the EC
abolish the obstacles of the free movement of empolyed persons?
These are the research points of this thesis. The thesis
concentrates mainly on an analysis of the following aspects: 1.
The concept of the free movement of persons in the EC. 2. The
provisions regarding the free movement of persons of the EC. 3.
The free movement of workers of the EC. 4. Persons to whom the
provisions regarding the free movement of workers are
applicable. 5. The obstacles of the free movement of workers in
the EC and the measures abolishing the obstacles.
