Summary: | The object of this thesis is to analyze the provisions of the Act respecting protection of personal information in the private sector in an attempt to foresee their impact on the use of medical information by insurance companies. This thesis contains a brief review of elementary principles related to the fundamental right to privacy, as well as their application in the medical context. This review is followed by a study of the historical context and the legislative evolution having led to the adoption of the Act. === Legal principles concerning access and use of medical information by insurance companies are studied and, based on those principles, the provisions of the Act respecting the protection of personal information in the private sector are analyzed. In conclusion, this thesis attempts to evaluate the effectiveness of this new statute.
