Previous issue date: 2014-06-16 === The scope of this study is to demonstrate the incompatibility between the regime of conditioning actions adopted by the Brazilian Code of Civil Procedure of 1973 (Eclectic theory of action) and the conception about the subject accepted thru the current 1988 Federal Constitution. This paper begins firstly by reviewing the ideology that underlies the formation of the current Brazilian State, making connections between the Constitutional State, Dignity and Civil Procedure, and secondly, by identifying the mainstay that gave rise to the emergence of so-called procedural science in the attempt to condemn the existing gap of the intended action of the State as a judge between yesterday and today. Immediately, after presenting considerations about the main theories of action, it moves over to the analysis of the country sub-constitutional legislation, which is complemented by the debate regarding the configuration or not, of the condition of the actions as a legal and procedural autonomous category. Finally, justifying the aforesaid incompatibility and bringing up the theoretical foundations inherent to this proposal, it strives for the recognition, despite the scope identified by the constitutional doctrine, of a procedural dimension of dignity, which consists of, mainly, in the substantial right of the contenders and the state's obligation to, if it is called up to intervene, to materially resolve the social conflicts === O presente estudo tem por escopo demonstrar haver incompatibilidade entre o regime do condicionamento das a??es adotado pelo C?digo de Processo Civil brasileiro de 1973 (teoria ecl?tica da a??o) e a concep??o acerca do tema que se imp?e diante da vig?ncia da Constitui??o Federal de 1988. Parte-se da revis?o da ideologia que subjaz a forma??o do atual Estado brasileiro, realizando-se conex?es entre os temas Estado Constitucional, Dignidade e Processo Civil para, num segundo momento, identificar-se o esteio que deu ensejo ao surgimento da denominada ci?ncia processual, no af? de denunciar o gueto existente entre o que hoje e ontem se pretendeu da atua??o do Estado-juiz. Em ato cont?nuo, ap?s apresentar considera??es acerca das principais teorias da a??o, passa-se a an?lise do regramento infraconstitucional p?trio, que vai complementado pelo debate concernente ? configura??o, ou n?o, das condi??es da a??o enquanto categoria jur?dico-processual aut?noma. Por fim, justificando ? aludida incompatibilidade e, trazendo ? baila os fundamentos te?ricos inerentes ? proposta em tela, pugna-se pelo reconhecimento, a despeito das demais dimens?es identificadas pela doutrina constitucional, de uma dimens?o processual da dignidade, que consiste, sobretudo, no direito (substancial) dos contendores, e na obriga??o estatal de, chamado a intervir, compor meritoriamente os conflitos sociais suscitados.
