Previous issue date: 2016-08-19 === A presente disserta??o ? resultado de uma pesquisa legislativa, doutrin?ria e
jurisprudencial sobre o contencioso de propaganda eleitoral e a possibilidade de uso
subsidi?rio das tutelas de urg?ncia previstas no novo C?digo de Processo Civil. A
problem?tica diz respeito ?s formas de efetiva??o das tutelas de urg?ncia -
ferramentas do processo civil ? concedidas em representa??es por propaganda
eleitoral il?cita, quando o cometimento da ilegalidade ocorre em redes sociais.
Busca-se, ao longo de seus cap?tulos, apresentar os conceitos de propaganda
pol?tica e suas subesp?cies: propaganda partid?ria, intrapartid?ria, eleitoral e
institucional. Al?m disso, mant?m-se um di?logo constante entre as fontes
normativas diversas como a Constitui??o Federal, a Lei das Elei??es, a Lei dos
Partidos Pol?ticos e as regras do novo C?digo de Processo Civil que regulam as
tutelas de urg?ncia. Com base em uma dogm?tica constitucional dos direitos
fundamentais, principalmente quanto aos direitos ? livre manifesta??o do
pensamento e ? informa??o, promove-se uma an?lise da principiol?gica que d?
arrimo ? utiliza??o das tutelas de urg?ncia nas contendas judiciais eleitorais de
propaganda. Identificam-se e conceituam-se as esp?cies de tutelas de urg?ncia,
externando-se o sincretismo processual adotado pelo novo CPC, explicando-se com
base em regras de hermen?utica cl?ssica e moderna quais tipos s?o permitidas em
contendas eleitorais. A obra se desenvolve e acaba por demonstrar que, apesar de
n?o haver regras expressas na legisla??o eleitoral que regulem o uso das tutelas de
urg?ncia no contencioso eleitoral de propaganda, seja por situa??es impostas pela
hodierna realidade tecnol?gica, seja por uma necessidade das partes em ter seus
direitos materiais resguardados, h? que se estabelecer uma comunica??o entre as
disposi??es do novo C?digo de Processo Civil e o Direito Eleitoral, guiada pelos
valores constitucionais, de modo a garantir um devido processo legal substancial. === This dissertation is the result of a legislative, doctrinaire and jurisprudential research
on the litigation of canvass and the possibility of alternative use of emergency
guardianships under the new Civil Procedure Code. The issue concerns the ways of
realization of emergency guardianships - the civil process tools - granted in representations
by illegal electioneering, when the illegality occurs in social networks. Search
presents the concepts about political advertising and their subspecies: party propaganda,
intraparty, electoral and institutional. Moreover, it is remained a constant dialogue
between the various legal sources such as the Federal Constitution, the Law
on Elections, the Law on Political Parties and the rules of the new Civil Procedure
Code that regulate the emergency guardianships. Based on a constitutional dogmatic
of fundamental rights, especially regarding the rights to free expression of thought
and information, it promotes an analysis of principles that gives upholder for the use
of the guardianships emergency in disputes of processes of advertising electoral. It is
identified and conceptualized the species of emergency guardianships, expressing itself
the procedural syncretism adopted by the new CPC, explaining itself with basis
of classical and modern hermeneutic rules which types are allowed in electoral disputes.
The work is developed and closes demonstrating that, although there is no express
rules in the electoral law governing the use of emergency guardianships in disputes
of advertising electoral, either for situations imposed by technological reality,
either by a need of the parties in have their rights materials safeguarded, it is necessary
to establish communication between the provisions of the new Civil Procedure
Code and the Electoral Law, guided by constitutional values, in order to secure a
substantial due process of law.
