Summary: | Public auction property is one of legal action made by the chargee in failing to demand a total loan balance of the chargor under the provisions of the National Land Code 1965. The auction can be applied through the Land Office or the High Court. The auction process will be assisted by Licensed Auctioneer appointed by the Land Administrator or the Registrar of the High Court. However each auctioneer must be a Licensed Auctioneer approved by Johor State Secretary before being appointed to carry out tasks such auctions. Nowadays, in carrying out the duties of this auction, Licensed Auctioneer faced with many challenges out there. The appointment must meet certain criteria to guide the appointment. Appointment procedures practiced nowadays there are no minimum criteria for the determination of the Johor State Licensed Auctioneer. Therefore, this study aims to suggest improvements in the procedure for the appointment of a licensed auctioneer. To achieve these three objectives set. The first objective is to review the implementation process of the appointment of Licensed Auctioneer in carrying out the execution order of a public auction at the Land Office. The second objective is to study the problems Licensed Auctioneer appointed by the Land Administrator. The third objective was to study the improvements that can be made to strengthen existing guidelines. A qualitative study conducted in the Johor State Land Administration has been involved respondents from Assistant Land Administrator, Licensed Auctioneer Johor and lawyers. The study found that there are some weaknesses that can be improved to strengthen the procedures for the appointment of the Johor State Licensed Auctioneer such as level of education, performance evaluation and other aspects.
