Summary: | Since the enactment of our Constitutional Charter which structured, at least from the legal point of view a Welfare State, several of its norms have not been fully effective. It is not only because part of our society has never admitted any innovations, but also for the reason that when we achieved redemocratization, the economic system had already begun a new phase, from the end of the real Eastern European socialism. The Federal Constitution affirmed Human Rights in the form of Fundamental Rights, among them the Right to the Environment Ecologically Balanced, which are the basic rights that guarantee the existential minimum to guarantee the Dignity of the Human Person. However, we have been witnessing a number of legislative changes over the last few decades, which are clear environmental setbacks. The communication of the economic system has greater social reverberation which leads us to a blindness regard to the true values to be protected.
