Summary:One of the most interesting contributions of Michel Foucault’s reflections during the 1970s has been to account for productive operation of power relations. In this paper I try to show that although Foucault has postulated a productive functioning of power relations, he maintained a purely repressive look on the law. Also, I try to show that the reduction of the law to a mere prohibition prevented him from giving account of the role of law in disciplinary societies.
