In accordance with the current legal provisions, free competition in the market can be violated in several ways; one of the ways is the abuse of a dominant position in the common market by one or more enterprises. The paper discusses theoretical analysis of the attitudes of contemporary legal theory, as well as the current national and EU provisions on the abuse of a dominant position with a review of the basic principles of competition policy in the EU and Serbia.
