Summary:The design means the appearance of the whole or a part of a product resulting from the features of, in particular, the lines, contours, colours, shape, texture and/or materials of the product itself and/or its ornamentation. A design shall be protected to the extent that it is new and has individual character. How should be examined the individual character, who is the person to whom may be related the overall impression it produces a product, what are the features of the informed user? This are the topics of the paper below, according to Romanian designs law, European regulation and case laws.
