<p>This paper intends to bring about a reflection on the judiciary system in the context of the <em>quilombolas </em>territorial conflicts. It focuses on the analysis of a recent landmark decision in favor of the territorial rights of the <em>Paiol de Telha </em>community, in order to understand the emancipatory character of this decision.</p> <hr /><p>Este trabajo busca reflexionar sobre la democratizaci&oacute;n de la justicia en el contexto de la judicializaci&oacute;n de los conflictos territoriales <em>quilombolas</em>.
