Summary:European Court of Human Rights when interpreting the art.1 from the Protocol 1 is constantly enlarging its field of application, modifying a classical vision of the goods and property. In this context, the pension right appears in a new form - as an object of protection of the norm described before. In this context, the Constitutional guarantees on pension rights were supplemented with property protection mechanism. Constitutional Court of Moldova could, however, retain property infringement retained as long as no violation of the right to pension.
