The present article gives an overview of the social historical and philologic contexts (from contrast of two certifications of a criminal proceeding) of three documentsof the18th century, pertaining to colonial documents on the captainship of São Paulo of the project “Resgate Barão do Rio Branco”, whose central subject is a case of military insubordination of a mulato against his superior, son of the governor of the captainship. The rescue and the diffusion of so interesting texts have importance so that research continues being done and so that new discovered add new knowledge to the society.
