Summary:This study aims to analyze the main historical aspects of the right to health in the Brazilian state, from 1930 - the period in which social rights are created - to the present day, giving focus to the judicialization of health. Points to factors that could be related to an alleged state's inability to perform fine form this social right. It is used the historical-evolutionary method, and the dialectical method. It is concluded that it can not meet all the demands and expectations population in this area and provided for in the Constitution with the resources currently available.
