Summary:This article analyses the appropriateness of the normative category of those decisions made by the heads of State and Government in meetings of the European Council that aim to regulate the temporary status within the European Union (UE) of those new states created after seceding from EU member-states, that is, before the conclusion of new accession treaties. The article concludes that since these decisions should be made by unanimity, in a simplified way, within the European Council and would have a transitory function, they are appropriate for the purpose they address.
