The purpose of this communication is to analyze, from a critical perspective, the legal conditions provided by the Spanish Immigration Law to obtain the authorization to work as a self-employed for foreigners. In order to fulfill the proposed objective, we start by analyzing, from a general perspective, the characteristics of the system. The different scenarios foreseen for access to self-employment by foreigners, both residents and non-residents, are briefly analyzed below. Finally, the deficiencies presented by the system and the conditions of its application are analyzed. All this to demonstrate that there is a situation of "formal" discrimination compatible with the legal system, which hinders the access of foreigners to the legal regime of self-employment.
