Summary:While religion undoubtedly helps to shape identity, its recognition by law as an element of identity has become problematic, notwithstanding the existence of strong safeguards such as freedom of religion or non-discrimination. Indeed, the situation with regard to the legal recognition of religion as an element of identity has become tense even though European case law emphasizes the contributory role of religion in the constitution of identity. Identity is inseparable from the otherness from which its legitimacy derives but with which it has an ambiguous, sometimes even disconcerting, relationship when one looks at its legal translation. Do the two notions not come to neutralize each other?
