Summary:The Civil Procedure Code disciplined the national judicial cooperation allowing greater simplicity and celerity in the interactions between the organs of the judiciary. However, the still incipient theoretical development of this institute has proved to be a decisive factor for its use so far diminished in proportion to its potential. In this intricate context and still lacking precise dogmatic guidelines, this article seeks to evaluate some basic aspects of national judicial cooperation in order to achieve a better understanding of its practical manifestations.
