Summary:This article propose to analyze the changes in the business sector of Brazilian state in the decades 80’s and 90’s. The problem is in the critical discussion of the forms of organization of the Brazilian national economy in the economic order begun in the 80’s. The business sector of Brazilian was one of the ways arranged for the insertion of the Brazilian economy in the economic order in the twentieth century, since the thirties, and from the 80’s with significant changes. Those changes are analyzed using the contextualization on theoretical considerations explored by literature, and the analysis of legislated documents. All institutional arrangements of state business sector were conducted on the issue of regulatory texts. The order of the documents indicated the ranking and teleology of the policies adopted during the period: (i) there are analysis of the Constitutions of 1967 (enforce at the beginning of the 80’s) and the Constitution of 1988, and the Constitutional Amendments of the 90’s; (ii) there are analysis of the legislated documents as ordinary laws and decrees of the Executive. With the analysis of the legislated documents, we describe and interpret the history of state-owned businesses from the documents that give the institutional, structural and functional outline of the state-owned businesses. The documents also express the general guidelines of the state economic policy, including the positions of the states in the business sector that are the object analyzed in this article.
