| Summary: | The goal of this study is to review the themes of constitutionalism and democracy from procedural and substantial views, making a contrast between Dworkin and Ely. The methodology used was the literature review. Inside of this work, it is presented a brief history of constitutionalism, the concept of judicial review, Dworkin’s substantialist view, and Ely’s procedural view. At the end of this work, it is made a contrast between proceduralist and substantialist theories, discussing constitutionalism in Brazil. As a conclusion, it was observed that the contemporary constitutionalism has challenges and both proceduralist and substantialist theories bring contributions to obtain a possible answer to the difficulties encountered in the debate between constitutionalism and democracy.O objetivo deste trabalho é discorrer sobre os temas do Constitucionalismo e da democracia a partir das análises procedimentalista e substancialista, fazendo um contraste entre as visões de Dworkin e Ely. A metodologia utilizada foi a revisão bibliográfica. No decorrer do trabalho apresentou-se um breve histórico do constitucionalismo, a conceituação da revisão judicial (judicial review), a visão de Dworkin, como exemplo da corrente substancialista, e o procedimentalismo na visão de Ely. Ao final fez--se um contraste entre as teorias procedimentalista e substancialista, levantando a situação do constitucionalismo no Brasil. Como conclusão, observou-se que o constitucionalismo contemporâneo encontra desafios e que tanto a teoria procedimentalista como a substancialista trazem contribuições para se obter uma possível resposta às dificuldades encontradas no debate entre o constitucionalismo e a democracia. |
