Description
Summary:The Supreme Court of Justice, Civil Cassation Chamber, decided to revoke the lower court ruling promulgated by the Superior Court of the Judicial District of Manizales and, instead, grant the protection requested by HABEAS CORPUS in favor of the Andean Bear of Eyeglasses, called "Chucho". In this way, the Barranquilla Zoo is legally obligated to release and immediately move Chucho to an area that meets the conditions of his species, his natural habitat, where he had lived for more than 18 years. The Court concludes that animals are subjects of law as long as they have been recognized as sentient beings, which implies that the supra-legal guarantee of freedom of persons, Habeas Corpus, is not incompatible with the legal status of non-human animal.
