Description
Summary:This paper together with noting statistical data and suitable (comparative) provisions in Croatian legislation provide an overview and description of the legislation in the Republic of Serbia by which lodging and examining complaints about the work of police officials is regulated. The authors also provide an overview of the provisions which regulate the liability of persons who, at the expense of police officials, abuse the constitutional right to complain. The authors' conclusion is that holistic legal regulation enables effective achievement of the rights to complain about the illegal actions of police officials. Here it is significant that, in checking the foundation for a complaint, public representatives are also included. The authors' suggestion is to prescribe by legal regulation the duties of the head of the Ministry of the Interior so that procedures can be instigated against police officials in whose work the commission has established that there have been violations of the law.
