This study aim to determine which are the foundations of the characterization of the right to a good work environment as a fundamental right. Initially, it conceptualizes the right to a good work  environment.  After,  it  mentions  the  distinction  between  formal  and  material fundamentality of the right to a good work environment under the post-positivist theory. Finally, it presents some substantial foundations of the characterization of the right to a good work environment as a fundamental right, using the deductive method from the analysis of the fundamental rights definition and the fundamental rights theory.
