The author points to two crucial factors that must be taken into account: on the one hand, the physical space available in prisons and the issue of overcrowding and, on the other hand, the number, selection and education of prison staff. Both factors are analyzed empirically and the human rights violations that come about due to the current functioning of the region’s prison systems are evaluated. The author suggests following the United Nations Rights and Obligations Model, and taking successful reforms as a guide, he rejects the privatization of prisons as a viable alternative, and argues in favor of the implementation of integrated criminal justice and prison system reform programs, which must be accompanied by democratic and inclusive social policies in order to reduce income inequality.https://anuariocdh.uchile.cl/index.php/ADH/article/view/20551
