| Summary: | Usefulness of criminal liability of legal persons. As a result
of analysis of literature and legislation, we have found the
following: a legal person may be liable for the off ences committed;
a legal person may be liable for the off ences committed,
whether or not identifi ed the individual who committed them;
the undertaking shall be released from liability if its leadership
does not bear any blame, and has taken all necessary measures
for the prevention of the off ence; if the legal person has
committed a criminal that does not mean that an individual
should not be drawn from the guilty criminal responsibility; in
the determination and application of the sanction must take
into account the nature of the off ence, pregnancy guilt, the
degree of involvement of natural and legal persons, etc |
