This article aims to understand the educational assistance based on existing laws and public policies to criminal enforcement. It uses literature and qualitative research. The field doing research is a Regional Penitentiary in the State of Piaui. Data collection occurred from September to December 2014, which were discussed and compared with national statistics to identify the obstacles to providing a quality education and be able to promote social reintegration, before the constitutional principles legitimizes the democratic state.
