Summary: | The reflections developed in this article are part of a research held with the goal of discussing the education role as political mediation in the dispute for hegemonic battle between opposite social classes. Based on critical-dialectical method, is firstly made a reflection, about the rights category and the contradictory role that it performs in marked conjunctures by market domain and exploration of working class, according the capital discusses, according to Brazilia right, its use to the interest of dominant class, and its repercussion in the promotion of ambiguous educational policies, that makes stronger the perspective of the backwards legitimating it as a social right to all citizens.
