Summary:The study aims to screen, in tracing the horizon in "Measure for Measure" by Shakespeare, develop a critique of legal positivism and judicial discretion, with the case study basis, consistent in the reasons released by the Court of Rio Grande do Sul if referring to the son in law that kills the father and want the right to sharecropping inheritance. The theoretical framework of the paper is the hermeneutical philosophy and philosophical hermeneutics (Heidegger/Gadamer), the Law as Integrity (Dworkin) and Critical Hermeneutics of law (Streck), in a (required) approach between Law and Literature for production constitutionally appropriate decisions.
