Summary:The right to property for quilombolas is founded on an element non-existent in Brazilian law: identity and recognition. The traditional juridical research intends to rebuild maroons social and  historical  framework  in  Brasil  by  different  recognition  spheres  due  to  abstract empiricism. The paradox of the “identity” as result of historical and social process of “differentiation” and “universalization” is worked as theoretical perspective of maroons historical reality’s, characterizing the “identification of and by the other”. This perspective allows criticize the category “recognition” and affirm the “social movement” function in maroons.
