Summary:Roman jurists and Christian theologians gave much thought and attention to the rescue of prisoners. The rescue of prisoners was a common practice throughout Europe, although in Spain it presented special characteristics as the legal position of Christian captives in the power of the Muslims, and their rescue through the payment of ransoms, was contemplated in municipal law, royal legislation, the Cortes and in Muslim law.
