The incidence of child labor is influenced by various factors such as poverty, child's condition, family and community culture. Hiring a child does not always have a negative impact, because with working children can train the physical, mental, social and intellectual abilities of children. Although in practice there is inevitably much discrimination or exploitation experienced by child laborers. Every child shall have the right to survival, growth and development and shall be entitled to protection from violence and discrimination as provided for in the Constitution of the State of the Republic of Indonesia Year 1945. A child is a person who is not yet 18 years of age, including a child who is still in the womb. The legal issues raised in this study are: What is the risk for underage child workers according to positive law in Indonesia? and how are child rights and legal protection for child labor under Law Number 13 Year 2003 regarding Employment connected with Law Number 35 Year 2014 on Children Protection? This research is normative juridical research with descriptive descriptive and descriptive descriptive research specification. This research is Library Research using secondary data. The employment of children as stipulated in the law is in fact closely related to the protection of the rights of children. The provisions prohibiting the employment of children as provided in the provisions of Article 68 of Law Number 13 Year 2003 regarding Employment which provides that every child has the right to protection by parents, family, community and state.
