Summary:The observance of equity in the formulation of public policy focused on access to the education of the disabled person is fundamental for autonomy and social inclusion. The recognition of disability as a difference, in a positive lens and, consequently, of the person with disabilities as a citizen, is to protect their rights in the national and international order. However, the legal mechanisms have not been sufficient to drive it away from the reality of exclusion experienced. Therefore, it is necessary to think of the public policies of attention to the person with disabilities, in particular, of education, in order to pursue not only the inclusion of the disabled person, but the transformation of society and, above all, the realization of social justice. It is a study based on the qualitative approach of bibliographic nature.
