Summary:The present monograph approach to the social function of copyright and access to knowledge in face of the individualistic aspect of copyright. First discusses the right of property in order to the present concept of social function. Analyzes historical evolution of property rights and the emergence of the idea of social function. Search circumscribe the copyright as a branch of property Law specifically intellectual property. It presents and discusses briefly the Law nº 9.610/98, differing economic rights of the author’s moral rights and it analyzes the system established by the Copyright Act confronting it with the Constitutional rights of access to education, culture, information and knowledge. We conclude that the principle of social function may be a response to the need for adjustment between the copyright protection system created by Law nº 9.610/98 and the constitutional rights related to access to knowledge.
