It aims at a better understanding of the importance of the application of fun-damental rights in relations between individuals, being necessary to always take into account the regulations brought by the Brazilian Constitution. Th e prominence of fun-damental rights in the mobilization of private law is unavoidable phenomenon, the result of the universality of concepts.Th e discussions about the way in which fundamental rights would infl uence the Inter privatus relationship had their beginnings in the twentieth century in Germany. In Brazil, the issue is being addressed by recent constitutional doctrine, analyzing its increasing incidence and effi ciency in the legal system.
