Summary:This paper analyzes the role of the tutor in the distance education (DE) in Brazil, from the Open University of Brazil (OUB), promoter of the Gender and Diversity at School (GDS) course, through the Federal University of São Paulo (UNIFESP). The methodological contribution is based on a genealogy of the legal provisions on distance education learning in Brazil and an analysis of the role of the teacher-tutor in the GDS. It is concluded that the difficulties experienced by the professionals involved are due to the influence of the state's ultraliberalism, present through the remuneration for aid grants, without an employment contract, consolidating the precarious work of those involved.
